How Is Inheritance Executed in DPRK

    The DPRK strictly establishes principles and orders in the execution of inheritance and correctly settles the issue of inheritance so as to contribute to the working people’s material wellbeing and the property consolidation of their family.

    Inheritance is executed by an inheritance executor in the DPRK.

    A citizen can appoint his or her inheritance executor by will and, if not, an heir becomes the executor. In case there are several heirs, they appoint one executor by mutual consent and inform population administration organ of the executor. If they fail to come to an agreement, the population administration organ chooses the executor according to the application of a person interested.

    An inheritance executor can make actions needed in the proper management of inherited properties and the inheritance execution. A person to be inherited and a person interested must not hinder the execution of inheritance. The person to be inherited and the person interested can make claim to judicial organ in case they have comments in examining the execution of inheritance.

    Before dividing inherited properties, the executor must classify individual property of a person, who inherits, from the ones provided commonly by his or her family members and the ones of their own and send notice on it to those who are to be inherited.

    The executor must leave a share of a person to be born on the basis of the document confirmed by a medical institution.

    If inheritance has been executed without leaving a share of a person to be born, the person who was inherited should give the share back to a person who was born.

    In case a person to be inherited fails to make his or her presence or is disqualified, the population administration organ must choose another person to take charge of the inherited property. In case a person who inherits decides by will a person to take charge of property, inheritance execution will be made according to it. Citizen or organ, enterprise and organization who have capacity to do can take charge of them.

    Difference in views related to inheritance must be solved through consultation and, if not, they can be submitted to a judicial organ to settle.
